Abstract

Ijtihad is a crucial process in the formation of Islamic law to address contemporary problems that continue to evolve. This research aims to examine the rules (ḍawābiṭ) of ijtihad maqāṣidī from the perspective of Nuruddin al-Khadimi, a contemporary figure in maqasid thought. The research method used is normative legal research with a qualitative approach based on library research. Data analysis was conducted descriptively and analytically by outlining and critically examining the rules of ijtihad maqāṣidī in Al-Khadimi's perspective. The results show that Al-Khadimi divides the rules of ijtihad maqasidi into two main categories: general rules and specific rules. General rules include the legality and divine nature of maqasid, comprehensiveness (syumuliyyah), moral dimensions, and rationality. Meanwhile, specific rules include the instruments of istislah (maslahah mursalah), 'urf (customs), and ta’lil (legal argumentation). The application of these rules serves as a boundary to ensure that ijtihad remains within the corridors of Sharia, avoids the subjectivity of personal desires, and produces legal products that are responsive and beneficial for humanity in this world and the hereafter
